The Lexus dealer associations, which include Lexus of Kelowna, (collectively the “Lexus Dealer Associations”), respect your right to privacy. This Policy outlines how the Lexus Dealer Associations’ privacy principles protect your privacy as a key part of our relationship with you. These privacy principles apply to all personal information that the Lexus Dealer Associations collect from consumers. Personal information refers to any personally identifiable information about you. It does not include aggregate information that does not identify you specifically.
The Lexus Dealer Associations may collect personal information provided by you to your Lexus dealership or to Lexus Canada, a division of Toyota Canada Inc., (“TCI”), including your name, address, telephone number(s), email address, driver’s license and insurance information. The Lexus Dealer Associations may also collect personal information from you through customer surveys, when you make inquiries or requests for information, or for a test drive, and when you visit the Lexus Dealer Associations’ web sites.
As part of the Lexus Dealer Associations’ on-going efforts to better understand your automotive needs and improve the products and the quality and efficiency of the Lexus Dealer Associations, TCI, and TCI’s dealership’s provision of products and services to you, the Lexus Dealer Associations may, from time to time, ask you to provide additional personal information, such as your purchase preferences, demographics, and lifestyle, through customer surveys or other means.
The Lexus Dealer Associations will also collect any information that you provide through your customer service inquiries or when we respond to your requests for information.
The Lexus Dealer Associations also collect information that you provide during visits to our web sites, including contact information, vehicle information, customer survey information, visitor’s dealership and language preferences, owner information, and contest entry information.
The Lexus Dealer Associations may use your personal information for the following purposes:
For the purposes outlined above, the Lexus Dealer Associations may share your personal information with TCI, Toyota Credit Canada Inc. (“TCCI”) and with Toyota (Lexus) (Scion) dealerships and dealer associations.
The Lexus Dealer Associations may also share your information with select marketing partners who may provide you with information about their products and services. You will be provided with an opportunity to opt-out of communications from the Lexus Dealer Associations, or our marketing partners.
Your personal information may be transferred to third party service providers that the Lexus Dealer Associations use to assist in managing and processing your personal information. The Lexus Dealer Associations’ third party service providers are required to use, maintain and disclose your personal information only in accordance with the Lexus Dealer Associations’ instructions to them and only on the Lexus Dealer Associations’ behalf.
The Lexus Dealer Associations will not disclose any of your personal information to any other persons, except (i) with your prior consent; (ii) in connection with a sale of all or substantially all of the assets of one of the Lexus Dealer Associations’ businesses or if we merge with or are otherwise acquired by a third party; (iii) to conduct investigations of possible breaches of law; (iv) to identify, contact, or bring legal action against someone who may be violating an agreement they have with us, TCI, TCCI, or with a Toyota (Lexus) (Scion) dealership; or (v) to protect our rights, safety or property; or (vi) as may be required or permitted by law.
The personal information that you provide to the Lexus Dealer Associations may be transferred outside of Canada for processing. The Lexus Dealer Associations may store personal information on servers located in other jurisdictions, including the United States. Please note that the privacy laws in such jurisdictions differ from Canadian privacy laws and that in some jurisdictions your personal information may be accessed by law enforcement authorities or the courts.

In other cases, your consent is understood, such as when you respond to a customer satisfaction survey, request product information, or register for updates.
By providing any personal information in any email request or any interactive activities on our web sites you consent to the Lexus Dealer Associations’ collection of that information.
You may at any time withdraw or change your consent to the Lexus Dealer Associations’ use or disclosure of your personal information, or request that the Lexus Dealer Associations delete it from our files, subject to legal and contractual restrictions. However, if you do not provide personal information required to supply a product or service, the Lexus Dealer Associations may not be able to provide that product or service.
Where required by law, the Lexus Dealer Associations will seek your further consent to any additional uses of personal information for which we have not obtained your consent previously.
The Lexus Dealer Associations will only send email, text or other electronic messages to you if you have asked for or otherwise agreed (either expressly or implicitly as may be permitted under the applicable law) to receive emails, texts or other electronic messages from the applicable Lexus dealer association. Any electronic message that you receive from the Lexus Dealer Associations will identify the applicable Lexus dealer association as the sender, enable you to contact that Lexus dealer association directly and provide for a means of unsubscribing from further electronic messages from that Lexus dealer association.
The Lexus Dealer Associations may also from time to time request your consent on behalf of any of or all of TCI, TCCI, Toyota (Lexus) (Scion) dealerships and other dealer associations, and Toyota marketing partners. Electronic messages that you receive from any of these entities will identify the sender, enable you to contact the sender directly and provide for a means of unsubscribing from further electronic messages from the sender.
Non-Personally Identifiable Information. When you visit our web sites, unless you tell the Lexus Dealer Associations who you are or reveal any other personal information, we do not collect or store any personal information about you. The only information the Lexus Dealer Associations collect and store is non-personally identifiable information such as the name of your Internet service provider, the type of the Internet browser you use, and referring web site and the pages you request. The Lexus Dealer Associations use this non-personally identifiable information to generate aggregate statistics regarding web site activity.
Cookies. Cookies are files that your web browser places on your computer's hard drive that permit the Lexus Dealer Associations to tell whether, and if so, how many times, you have accessed our web sites previously, your language of choice, your dealer of choice, the province in which your internet provider resides, internet user behavioral analysis, and your computer system’s flash preferences. You may choose to decline to accept cookies if your browser permits but doing so may affect your use of our web sites and your ability to access certain features of the web sites.
Pixel tags. A pixel tag is a transparent graphic image, sometimes called a web beacon, clear GIF or a tracking beacon, placed on a web site or in an e-mail, which indicates to us that a page or e-mail has been viewed. In addition, a pixel tag may tell your browser to get content from another server.
Third-Party Links. Our web sites may contain links to other sites. When you click on a link that takes you to third party web site, you will be subject to the third parties' privacy policies. While the Lexus Dealer Associations support the protection of privacy on the Internet, we are not responsible for the actions of third parties or for their privacy practices. The Lexus Dealer Associations encourage the users of our web sites to be aware when they leave the web sites and to read the privacy policies of each and every web site with which they interact.
Children. The Lexus Dealer Associations do not use our web sites to knowingly solicit personal information from or to market to persons under the age of majority. If a child has already provided us with Personal Information, his or her parent or guardian may contact us for the purpose of requesting this information be deleted.
The Lexus Dealer Associations may license technology to serve advertisements on our own web sites and within its content as that content is served across the Internet. In addition, we may use third-party ad networks, publishers and other entities to serve advertisements and third party analytics vendors to evaluate and provide us with information about the use of our web sites and viewing of our content.
Ad network providers, data providers, publishers and other media-related companies, and/or analytics service providers may set and access their own cookies, pixel tags and similar technologies on your device’s web browser and they may otherwise collect or have access to information about you. We and they may target advertisements for products and services in which you might be interested based on your visits to both the Lexus Dealer Associations web sites and other web sites. We and they may use a variety of companies to serve advertisements.

The Lexus Dealer Associations retain your personal information as long as is required for the purposes identified when you provided the personal information and for any new purposes identified to and consented to by you, or to meet any legal requirements, and for an appropriate time thereafter.
Your personal information will be kept in files stored in databases located in Toronto, Ontario.
The Lexus Dealer Associations protect your personal information using security systems appropriate to the sensitivity of the information. Our web sites are members of the Entrust Digital Certificate Program which involves applying security sockets layer software encryption technology to all information that you submit through the web sites. We apply security safeguards required for compliance with the Entrust Digital Certificate Program. Please note: You are solely responsible for maintaining the confidentiality of your password(s).
Personal information may only be accessed by persons within our organization, or our third party service providers, who require such access to carry out the purposes identified to you.
Although we have taken reasonable and prudent measures to protect our web sites, computer systems and any personal information that we have collected from unauthorized use, access, disclosure, misuse, alteration or destruction, no security measures can provide absolute protection.
